HB 87 IS COMING BACK.
What HB 87 would change
HB 87, “Non-Consensual Touching Clarification,” proposed extending New Mexico’s adult criminal sexual contact law to contact through clothing. The 2025 bill would amend Section 30-9-12, which defines criminal sexual contact involving a person age 18 or older. Its central change removes the restriction to unclothed intimate parts, so clothing would no longer exclude otherwise qualifying unlawful, intentional, nonconsensual contact from that definition.
The proposal concerns intimate areas including the groin, buttocks and breasts. It did not become law in the 2025 session. The August correspondence below concerns reintroduction; the September 10 filing in this case charges battery.

Wirth explained that the 2025 bill reached Senate Judiciary late in the session and that the session ended before a final Senate floor vote, and he suggested focusing on reintroduction in 2027.
